These Terms and Conditions (“Terms”) govern access to and use of the EVIVA website and all services offered under its brand, including but not limited to: Elite del Trading, Dinero Desbloqueado, Bitclass, and any other digital product or service provided by EVIVA ED Computer Training LLC, with registered office at Ubora Tower, Marasi Drive, Office 3102, Business Bay, Dubai, United Arab Emirates (“EVIVA”).
By using the website or purchasing any service or product, the User agrees to be legally bound by these Terms.
1. Introduction and Acceptance
By accessing or using EVIVA’s website and services, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional guidelines, rules, or terms posted on the Platform. If you do not agree to these terms, you should not use the services.
2. Eligibility
You must be at least 18 years old or have obtained the consent of your legal guardian to use our services. You agree to provide true, accurate, and complete information during registration and keep it updated.
3. Services Provided
EVIVA provides access to digital learning products and services including online courses, video lessons, downloadable materials, events, and coaching. These services are offered through our website or third-party platforms such as Hotmart or Bitclass.
4. Registration and Contracting
Users must select the product of interest and will be redirected to a third-party platform such as Hotmart for purchase. The user must register and accept the third party’s terms. Upon confirmation of payment, access to the digital product will be granted.
5. Payments and Pricing
All prices are displayed in euros or other local currencies and include applicable taxes unless otherwise indicated. Payments must be made in full before access to any service is granted. EVIVA reserves the right to modify pricing and correct pricing errors. All transactions are processed through third-party providers such as Hotmart, which is responsible for transaction security.
6. Right of Withdrawal
In accordance with consumer regulations, users may request a refund within fourteen (14) calendar days from the date of purchase, provided that the digital content has not been accessed or downloaded. Once access to the service or content has begun, the right of withdrawal is forfeited.
To exercise the right of withdrawal, the user must notify EVIVA by email at within the time limit. If approved, the refund will be processed within 14 days. Any guarantee period offered by third-party platforms (e.g., Hotmart’s 7-day refund) applies alongside this right.
7. Access to Content
Access is provided after payment confirmation. The content may include online courses, eBooks, video lessons, and recorded webinars. Access is granted for an indefinite period unless otherwise specified in the product description. Access is personal, non-transferable, and limited to the user.
8. Account and Security
Users are responsible for keeping login information secure. Any unauthorized use must be reported immediately. EVIVA disclaims liability for losses resulting from negligence or improper account handling by the user.
9. Modifications and Cancellations by EVIVA
EVIVA reserves the right to update, alter, or cancel its services and content. If a purchased product is permanently removed or significantly changed, users will be notified and may request a partial refund proportional to the unused portion of the product.
10. Acceptable Use and User Conduct
Users may not use the platform for illegal, harmful, or abusive purposes. Prohibited behaviors include sharing login credentials, unauthorized resale, redistribution, or recording of content, and using the platform to transmit offensive, threatening, or defamatory material.
11. Electronic Contracting and Evidence
All contractual relationships are formed electronically. Users agree that EVIVA’s digital records, including email confirmations and platform logs, constitute legally valid evidence.
12. Digital Content Licensing
Content is provided under a limited, non-exclusive, non-transferable license for personal, non-commercial use. Reproduction, publication, or commercial exploitation without prior written consent is strictly prohibited.
13. Intellectual Property Rights
All intellectual property on the platform, including videos, written materials, brand names, logos, and structure, is the exclusive property of EVIVA or its licensors. Any unauthorized use constitutes a breach of these Terms and may lead to legal action.
14. Platform Downtime and Technical Interruptions
EVIVA is not liable for temporary service interruptions due to maintenance, updates, or third-party issues. In cases of prolonged outages, reasonable compensatory measures may be considered on a case-by-case basis.
15. Intermediation Clause
Some EVIVA products include referrals to third-party professionals (e.g., traders or mentors). EVIVA acts solely as a facilitator and does not participate in the delivery of such third-party services. EVIVA disclaims all liability for the conduct or quality of services provided by third parties.
16. Limitation of Liability
- EVIVA shall not be liable for:
- Technical issues outside of its control;
- Improper or unauthorized use of the platform;
- Financial decisions made by users based on the educational content;
- Losses derived from third-party services.
17. Jurisdictional Compliance
EVIVA is a company established in the United Arab Emirates and operates primarily under UAE laws and regulations. However, for users located within the European Union or the United States, EVIVA strives to comply with all applicable consumer protection, digital commerce, and data protection regulations, including but not limited to the EU General Data Protection Regulation (GDPR) and relevant directives on e-commerce and distance selling.
Users are responsible for ensuring that their use of the services is permitted under the laws applicable to their jurisdiction. In the event of conflict between local consumer rights and these Terms, the provisions granting greater protection to the consumer shall prevail.
18. Export and Sanctions Compliance
EVIVA complies with applicable export control laws and economic sanctions programs. Users may not use or access the platform if they are located in a country or territory that is subject to comprehensive international sanctions, or if they are listed on any applicable denied-party list.
By using the platform, the User represents and warrants that they are not subject to any such sanctions or restrictions.
19. Force Majeure
EVIVA will not be liable for delays or failure in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, cyberattacks, government restrictions, or communication failures.
20. Children’s Online Protection
EVIVA does not knowingly collect or solicit personal information from children under the age of 13 (or under 16 in the EU). If EVIVA becomes aware that it has collected data from a minor without parental consent, it will take appropriate steps to delete such data immediately.
21. U.S. Federal Trade Commission (FTC) Disclosures
In accordance with U.S. guidelines, where applicable, EVIVA discloses affiliate relationships, sponsored content, and endorsements. Any educational or promotional materials including testimonials or results must be considered illustrative and not guaranteed outcomes.
22. Dispute Resolution and Arbitration
Any dispute arising from the use of the Platform shall first attempt to be resolved amicably. If unresolved, the matter shall be referred to arbitration in Dubai under the Dubai International Arbitration Centre (DIAC).
23. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the United Arab Emirates. Unless otherwise required by law, disputes shall be subject to the jurisdiction of Dubai courts.
24. Language
These Terms are drafted in English. In case of discrepancies between translations, the English version shall prevail.
